April is Fair Housing Month, a time to recognize and reflect on the protections provided by the Fair Housing Act, which was enacted in 1968 to ensure equal access to housing regardless of race, color, national origin, religion, sex, familial status, or disability. 

While the law was established over 50 years ago, its relevance continues today—especially in competitive real estate markets like Fairfield County, where multiple offers, tight timelines, and creative offer strategies are the norm. 

One of the questions that often comes up in these situations is:  Are buyer "love letters" a Fair Housing risk? 

 

A Gray Area Worth Thinking About 

Buyer letters—often called “love letters”—are written by prospective buyers in hopes of appealing to a seller’s emotions. These letters might include stories about the buyer’s family, why they love the home, or how they imagine their future there. While heartfelt and often well-meaning, they may contain personal details that touch on protected characteristics under Fair Housing laws—like religion, familial status, or national origin. 

The concern? If a seller’s decision is influenced by these details, it could potentially open the door to claims of unintentional discrimination. It’s one of those gray areas where good intentions may still carry legal risk. 

What About Sellers? 

For many sellers, parting with a home is an emotional process, and it’s natural to wonder who the next owners will be. Some sellers find comfort in knowing that a home they’ve cherished will be loved by someone else. But reviewing personal letters, even casually, could unknowingly influence decisions in ways that intersect with Fair Housing protections. 

So, what’s the right move? That’s the tricky part—and part of the reason this topic continues to generate debate within the real estate industry. 

Strategic (and Neutral) Ways Buyers Can Stand Out 

Whether or not buyer letters are used, there are many effective ways to craft a compelling offer in today’s competitive market: 

  • Strong financing with a pre-approval letter 

  • Favorable closing timelines 

  • Fewer contingencies (where appropriate) 

  • A clean and well-organized offer package 

In the end, the goal is the same for both buyers and sellers: to engage in a fair, transparent, and successful transaction.
